FAA ISSUES NOTAM 9/5145 TO REPLACE NOTAM 3/2123 (DISNEY TFR)
BACKGROUND: On March 18, 2003, the FAA issued NOTAM 3/2123 which established a permanent “Temporary” Flight Restriction which restricted all General Aviation aircraft from operating within 3 NM miles around Disneyland Theme Park below the altitude of 3000 feet MSL. The TFR allowed for the exception of Public Service Aircraft, Emergency Medical Aircraft, and Department of Defense Aircraft, as well as those aircraft authorized by ATC for operational or safety purposes, including aircraft arriving or departing from an airport using standard air traffic procedures. ACTION: On February 10, 2009 the FAA issued NOTAM 9/5145 which went into effect February 17, 2009 at 0801 UTC. The new NOTAM reads as follow:

THIS NOTAM REPLACES NOTAM 3/2123 DUE TO THE WAIVER WEBSITE CHANGE AND LANGUAGE CLARIFICATION. THIS NOTAM COMPLIES WITH STATUTORY MANDATES DETAILED IN SECTION 352 OF PUBLIC LAW 108-7 AND AS AMENDED BY SECTION 521 OF PUBLIC LAW 108-199. PURSUANT TO 49 USC 40103(B), THE FEDERAL AVIATION ADMINISTRATION (FAA) CLASSIFIES THE AIRSPACE DEFINED IN THIS NOTAM AS ‘NATIONAL DEFENSE AIRSPACE’. ANY PERSON WHO KNOWINGLY OR WILLFULLY VIOLATES THE RULES CONCERNING OPERATIONS IN THIS AIRSPACE MAY BE SUBJECT TO CERTAIN CRIMINAL PENALTIES UNDER 49 USC 46307. EFFECT OF CHANGE: As a result of the above issuance of NOTAM 9/5145, the PHPA wants pilots to understand two specific aspects of the change to the defined airspace:
1. The new NOTAM reclassifies the airspace as a “National Defense Airspace”. This comes along with stricter enforcement and harsher penalties for pilots who enter the TFR without authorization.
2. The new NOTAM eliminated the phrase: “including aircraft arriving or departing from an airport using standard air traffic procedures”. Now it requires the PIC to be in contact with ATC in all aspect of operations while arriving or departing to a heliport within the new “Disney National Defense Airspace”.
The PHPA suggests that all members familiarize themselves with the language of NOTAM 9/5145 prior to flight operation in the vicinity of the Disneyland Theme Park.
